Legal Separation Legal separation is not the same as divorce, and is usually used when one spouse requires financial support pending a divorce, or one party wants a court to order property distribution. Neither spouse is permitted to remarry and both may still be liable for marital debt. Legal separation is not the equivalent of divorce, and is usually only used for financial or property issues.
